This is the privacy policy ("Privacy Policy") that governs how FTW LLC and our affiliated companies ("FTW", "For The Win Robotics", "we", "our" or "us") use Personal Information (defined below) that we process in connection with your use of our websites, www.ftw-robotics.ai and www.ftwcode.ai, and any other web portal we operate that links to this Privacy Policy, our platform, our mobile applications, and all software, services, extensions, subdomains, and application programming interfaces related thereto (collectively, our "Service").

FTW makes its Service available to individuals ("user", "you", or "your") in accordance with our Terms of Service, available at www.ftw-robotics.ai/terms. Please read this Privacy Policy carefully to better understand how we collect, use, and disclose Personal Information about you as you use our Service.

1Introduction

We are committed to respecting privacy and recognize the need for appropriate protection and management of any Personal Information that is shared with us as part of using our Service. As used in this Privacy Policy, "Personal Information" means any information that identifies, relates to, describes, or is reasonably capable of being associated with an identified or identifiable natural person. We may collect Personal Information from you directly through a web form, or indirectly through information you upload to our Service, as discussed more fully in the sections below.

You may choose whether or not to provide or disclose Personal Information in connection with your use of our Service. If you choose not to provide the Personal Information we request, you may still visit and use parts of our Service, but may be unable to access or use certain features, options, programs, products, and services.

Our Service may contain links to third-party websites, products, services, and advertisements that are not owned or controlled by FTW. We are not responsible for the privacy practices or the content of those third-party websites, products, services, and advertisements, and you visit them at your own risk.

2Categories of Personal Information We Collect

We and our service providers may collect, and you may consent to provide, the categories of Personal Information set forth below in order to provide our Service to you, or because we are legally required to do so:

We do not collect Social Security numbers, driver's license or other government-issued identification numbers, precise geolocation, biometric identifiers, or other categories of sensitive personal information in the ordinary operation of our Service. If this changes, we will update this Privacy Policy and, where required, obtain your consent.

3When Personal Information Is Collected

FTW collects certain information that may constitute Personal Information in the following ways.

Contact Information

In various areas of our Service and in printed materials, we provide you the opportunity to submit a form with basic contact information, such as your name, email, or mailing address. With your permission, FTW uses such information to inform you of new products, technical information and services, and upcoming events that may be of interest. If you no longer wish to receive these emails, the opt-out process is described in Section 10 of this Privacy Policy. You may also subscribe to an FTW email list by signing up within our Service or by contacting FTW staff directly, and you may unsubscribe by following the instructions in the email.

Service Login Information

We process the username and password of users to enable secure logging into our Service, and we process information regarding your role to appropriately control access to restricted content. We process this Personal Information only as necessary to provide our Service under our Terms of Service and to further our legitimate interests in protecting our Service and content.

Payment Information

When you purchase services or products from us, third-party service providers acting on our behalf process payment information, including payment card details and billing and shipping addresses, to help us fulfill your orders. Any Personal Information collected by such third parties will be subject to the third party's privacy policy, in addition to this Privacy Policy.

Personal Information Collected by Third Parties

Please note that we use certain third-party service providers on our Service to enhance your experience or deliver certain services. These providers may collect Personal Information about you in performing their services or functions on our Service.

Social Media

We may work with certain third-party social media providers to offer their social networking features through our Service, for example so that you can share information about your experience. These services may be able to collect information about your activity on our Service and may notify your contacts that you are a user of our Service, in accordance with applicable law and their own privacy policies. If you choose to access or make use of third-party social networking services, we may receive information about you that you have made available to those services.

4Information Collected Automatically

Certain information on our Service is collected automatically by means of various software tools. We have a legitimate interest in using such information to assist in login, systems administration, information security and abuse prevention, to track usage trends, and to analyze the effectiveness of our Service.

Log Files

The information inside our log files includes internet protocol ("IP") addresses, type of browser, Internet Service Provider ("ISP"), date and time stamp, referring and exit pages, clicked pages, and other information your browser may send to us.

Cookies

Cookies are small pieces of data, stored in text files, that are placed on your computer or other device when websites are loaded in a browser. They are widely used to remember you and your preferences, either for a single visit (through a "session cookie") or for multiple repeat visits (using a "persistent cookie"). Web beacons are small electronic images that help us operate and improve our Service. We do not use these technologies to build advertising profiles or to serve third-party targeted advertising.

5The Purposes for Which We Use Personal Information

6How We Disclose Personal Information

Our Third-Party Providers

We transfer Personal Information to our third-party service providers to perform tasks on our behalf and to assist us in providing our Service, for example service providers who assist us with hosting, data storage, security, payment processing, shipping, communications, technical and customer support, application development, and analytics. We enter into agreements that limit these providers' use of Personal Information to the purpose of providing services to us, and we use commercially reasonable efforts to engage only with providers that maintain appropriate privacy and security practices.

Aggregate and De-Identified Information

To better serve our users and improve our Service, FTW may conduct research based on Personal Information and other information provided to FTW. This research may be compiled and analyzed on an aggregate or de-identified basis that does not identify any user personally, and we may share such aggregated or de-identified information with our affiliates, agents, and business partners, and to describe our Service to current and prospective partners.

In the Event of Merger, Sale, or Change of Control

We may transfer or assign this Privacy Policy and any Personal Information to a third-party entity that acquires or is merged with us as part of a merger, acquisition, sale, or other change of control, including as the result of a bankruptcy proceeding.

Other Disclosures

We may disclose Personal Information about you if we have a good-faith belief that disclosure is helpful or reasonably necessary to: (i) comply with any applicable law, regulation, legal process, or governmental request; (ii) enforce our Terms of Service, including investigations of potential violations; (iii) detect, prevent, or otherwise address fraud or security issues; or (iv) protect against harm to the rights, property, or safety of FTW, our users, or the public.

7Retention of Personal Information

We retain Personal Information only for as long as is reasonably necessary to fulfill the purposes described in this Privacy Policy and to comply with applicable law. We maintain a written data retention policy that sets forth the purposes for which Personal Information is collected, the business need for retaining it, and a timeframe for its deletion. When Personal Information is no longer reasonably necessary for the purposes for which it was collected, we delete or de-identify it using reasonable measures.

8Data Security

The privacy and security of Personal Information is very important to us. Taking into account the nature, scope, context, and purposes of processing Personal Information, FTW has established, implemented, and maintains reasonable and appropriate technical, administrative, and organizational safeguards, including a written information security program, designed to protect the Personal Information we process. However, no method of transmission over the Internet, or method of electronic storage, is one hundred percent secure. Therefore, while we strive to use commercially acceptable means to protect Personal Information, we cannot guarantee its absolute security.

9Children's Privacy

FTW markets and provides its Service to educators, schools, and adult learners. Educators are our customers and users. We collect Personal Information about an educator only when the educator chooses to provide it, for example by submitting a form or by becoming a customer.

Our Service is not directed to children, and we do not market to children. We do not knowingly collect Personal Information from children under the age of eighteen (18), including children under the age of thirteen (13) to whom the Children's Online Privacy Protection Act ("COPPA") applies. Our curriculum is designed to be delivered by educators to their students, and the educator is responsible for how the Service is used in their classroom or program. We do not require, solicit, or collect Personal Information directly from students, and educators should not submit students' Personal Information to us.

If you believe that a child has provided us with Personal Information without appropriate authorization, please contact us using the details in Section 15. If we learn that we have inadvertently collected Personal Information from a child, we will delete it using reasonable measures.

10Email Communications

You may choose not to receive future promotional or advertising emails from us by selecting the unsubscribe link at the bottom of each such email. You cannot opt out of receiving transactional emails related to the performance of our Service. Please note that even if you opt out of promotional emails, we may still send you a response to any "Contact" request, as well as administrative, maintenance, and operational emails, for example in connection with a password reset request.

11Your U.S. State Privacy Rights

Depending on the state in which you reside, you may have certain rights with respect to your Personal Information under applicable state privacy laws, including the California Consumer Privacy Act as amended by the California Privacy Rights Act ("CCPA/CPRA"), and comparable laws in other states. We review and update this Section at least annually. Subject to certain conditions and exceptions, these rights may include:

How to Exercise Your Rights

To exercise any of the rights described above, please contact us at privacy@ftw-robotics.ai. Please tell us which right you are exercising and provide contact information so we can respond. We must verify your identity before fulfilling your request, and if we cannot initially verify your identity we may request additional information solely for the purpose of verification. You may use an authorized agent to submit a request on your behalf, in which case we may require proof of the agent's authorization and verification of your identity. We will respond within the timeframe required by applicable law. If we decline your request, you may, where applicable state law provides, appeal that decision by replying to our response.

California Notice

If you are a California resident, the CCPA/CPRA provides the rights described above with respect to the categories of Personal Information identified in Section 2 of this Privacy Policy. We collect those categories from the sources, and for the business purposes, described throughout this Privacy Policy, and we disclose Personal Information to the categories of recipients described in Section 6. We do not sell or share Personal Information as those terms are defined under the CCPA/CPRA, and we have not done so in the preceding twelve months, including with respect to consumers under sixteen years of age. California's "Shine the Light" law permits California residents to request information about our disclosure of Personal Information to third parties for their direct marketing purposes; we do not disclose Personal Information to third parties for their own direct marketing purposes.

12Global Privacy Control and Opt-Out Signals

Some browsers and browser extensions can transmit opt-out preference signals, such as the Global Privacy Control ("GPC"). Where required by applicable law, we treat a valid GPC signal received from your browser or device as a request to opt out of the sale or sharing of Personal Information associated with that browser or device. Because we do not sell or share Personal Information or use it for targeted advertising, most of our processing is not affected by these signals, but we honor them where the law requires.

13International Users

Please note that our Service is directed toward users who reside in the United States. By using our Service, you consent to the collection, storage, processing, and transfer of Personal Information in and to the United States, pursuant to the laws of the United States. While the United States may not offer the same level of privacy protection as your own country, we commit to uphold the privacy protections explained in this Privacy Policy.

14Changes to This Privacy Policy

As our organization changes over time, this Privacy Policy is expected to change as well. We reserve the right to amend this Privacy Policy at any time by posting the amended Privacy Policy on our Service, and we will update the "Last Updated" date above. We may email periodic reminders of our notices and terms, but you should check our Service frequently to see the current Privacy Policy in effect and any changes that may have been made to it.
